The arbitration shall be conducted on an individual basis, and you agree that you may not bring claims against us as a plaintiff or class member in any purported class action, class arbitration, or representative proceeding.

10.3 Exceptions to Arbitration

Notwithstanding the above, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights or unauthorized disclosure of confidential information. Claims that are within the jurisdictional threshold of small claims court may also be brought in the applicable small claims court.

10.4 Waiver of Jury Trial

TO THE EXTENT PERMITTED BY APPLICABLE LAW, BOTH PARTIES HEREBY IRREVOCABLY WAIVE ANY AND ALL RIGHTS TO A TRIAL BY JURY IN ANY ACTION, PROCEEDING, OR CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES.

10.5 Time Limitation on Claims
